These terms and conditions form the basis on which you may visit and use our website, and order goods from us. Please read them carefully as they contain important information.

General terms and conditions

This site is owned and operated by Transition Kites Ltd of 4 Highfield Road, Worthing, West Sussex, England, BN13 1PX. Our company registration number is 07346760, registered in England, and our VAT Registration number is 104 3884 28. Accuracy of content

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. If the price of the goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, then you will of course have the right to cancel your order. Any weights, dimensions and capacities given about the goods are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

Damage to your computer

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Availability

All items are subject to availability. We will not be liable to you for any failure or delay to fulfil an order due to products being out of stock, withdrawn or discontinued. We will inform you as soon as possible if the goods you have ordered are not available. Where a product is temporarily out of stock, we will advise you of when we expect to be able to fulfil your order, however this will be an estimate and shall not be binding on us.

Ordering errors

You are able to correct errors on your order up to the point on which you click on "Proceed to Payment" during the ordering process.

Payment terms

We accept credit card, debit card and bank account payments and these are processed securely by PayPal. You do not need a PayPal account.
We accept no liability if a delivery is delayed because you did not provide the correct payment details. If it is not possible to obtain full payment for the goods from you, then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.

Delivery charges

Our prices include delivery charges to addresses in mainland UK. If you wish to place an order for delivery to an address other than mainland UK, please contact us before placing an order and provide details of the address to which you require the order to be delivered. We will provide you with a quote for delivery. If you proceed with an order for which a delivery charge is applicable, delivery charges vary according to the type and quantity of goods ordered and can be refunded only on occasions specified in these Terms and Conditions, or as required by law.

Delivery

We will deliver the goods to the address you specify for delivery in your order, and it is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. Unless we say otherwise, our aim is to deliver your goods to you within 5 working days, after receiving your full payment, but delivery dates and times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time. Time for delivery shall not be of the essence of the Contract.

In some cases a signature may be required upon delivery.

Risk and ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

Acknowledgement and acceptance of your order

As part of the ordering process you will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on despatch of the good(s) ordered.

Cancellation rights

You have the legal right to cancel your order within seven days of receipt of your goods (with the exception of any made to order items). You must do so in writing either by letter to Transition Kites Ltd of 4 Highfield Road, Worthing, West Sussex, England, BN13 1PX or by email to contact@transitionkites.com. We regret that a phone call is not acceptable. The effective date of your cancellation is the date on which you posted the letter to us giving notice of cancellation (we will ask you to provide evidence of having posted the cancellation notice, such as a certificate of posting) or the date on which we receive your email giving notice of cancellation. You are required to return the goods to us within 10 days of notifying us that you are cancelling the order and to pay for the return packing and postage. We recommend that you keep all receipts for postage or carriage, in order to provide proof of return. You have a duty to take reasonable care of the goods while they are in your possession, and you must take reasonable care to ensure that we receive the goods and that they are not damaged in transit. Even if you have opened the packaging we will expect that you will return the goods as new or with their original packaging. We will refund you the total price of the goods, including any delivery charges that you paid to us, within 30 days of the effective date of the cancellation of your order.

Returns and Refunds

In the case of the despatch of an incorrect item, you must notify us within 7 days after delivery by email to contact@transitionkites.com. You are entitled to return the goods to us and we will redeliver the correct order at no cost to you. We recommend that you keep all receipts for postage or carriage, in order to provide proof of return. We will reimburse you the return postage cost. You have a duty to take reasonable care of the goods while they are in your possession, and you must take reasonable care to ensure that we receive the goods and that they are not damaged in transit. Even if you have opened the packaging we will expect that you will return the goods as new or with their original packaging.

If any products are faulty or defective, you must return them to us within 3 weeks of delivery. We recommend that you keep all receipts for postage or carriage, in order to provide proof of return. We will reimburse you the return postage cost. At our discretion, we will replace or repair the products free of charge and redeliver them at no cost to you, or we will provide a refund of the price that you paid us.
In the unlikely event that we are unable to deliver your goods within 30 days after you placed your order, we will inform you and seek to agree a revised date for delivery of the goods. You do not have to agree to a revised date. If you do not agree to a revised date, we will refund all money that you paid us in relation to the undelivered goods including the postage and packaging applicable to them.

Warranties

We shall only extend the benefit of the manufacturer's warranty to you, and do not separately warranty the products.

In the event of a product requiring replacement or repair under the warranty, you must contact the manufacturer directly.

Exclusion of liability

Any disclaimers and exclusions of liability in these terms and conditions shall be governed by and construed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
